The EPA’s decision in 2025 to reopen the 2009 Greenhouse Gas Endangerment Finding marked a historic turning point in American environmental and energy policy. Following the statutory public comment period and a comprehensive review of the scientific, legal, and administrative record, the EPA concluded that the Greenhouse Gas Endangerment Finding should be rescinded. In doing so, the Agency addressed many of the same scientific and legal concerns FAIR Energy Foundation raised in its 2018 Petition for Reconsideration.
For FAIR Energy Foundation, this represents far more than a regulatory action. It is a reaffirmation that science must remain open to scrutiny, that government decisions must be transparent and accountable, and that public policy should follow the evidence wherever it leads.
According to the EPA’s final analysis, rescinding the Endangerment Finding is expected to eliminate regulatory burdens estimated in the trillions of dollars over time, reducing costs borne by American families, workers, manufacturers, businesses, and consumers. These savings represent resources that can instead be invested in innovation, economic growth, higher wages, domestic manufacturing, affordable energy, and improved standards of living.
FAIR Energy Foundation has always believed that environmental stewardship and human prosperity are complementary—not competing—objectives. Sound science, affordable and abundant energy, technological innovation, and responsible environmental protection work together to improve the quality of life for present and future generations. One cannot fully benefit without the other.
We commend EPA Administrator Lee Zeldin and Secretary of Energy Chris Wright for their leadership, integrity, and willingness to undertake a comprehensive review of one of the most consequential regulatory determinations in modern American history. Their commitment to scientific inquiry, transparency, and honest public policy has helped restore confidence that government decisions should be grounded in evidence rather than political ideology.
We also wish to express our deepest appreciation to Peter Ferrara, whose legal scholarship, intellectual leadership, and unwavering commitment to scientific integrity made extraordinary contributions to FAIR Energy Foundation and to our 2018 EPA Petition. His work was instrumental in helping frame many of the issues that ultimately became central to this national debate.
Our gratitude also extends to the many scientists, engineers, economists, attorneys, researchers, policy experts, and authors whose published work informed our petition and strengthened the case for a thorough reexamination of the Endangerment Finding. We stand upon the shoulders of countless individuals dedicated to the pursuit of truth through rigorous scientific inquiry.
